1. Acceptance of Terms
By using AfrocaEat (AfrocaEat.ca, AfrocaEat.fr, AfrocaEat.com) to order food or offer services, you agree to these terms in their entirety.
2. Registration and Social Login
You can create an account directly or use a third-party API (TikTok, Google, Apple). You are responsible for the confidentiality of your credentials. By using third-party login services, you also agree to comply with their respective terms of use and privacy policies.
3. Platform Usage, Orders and Payments
AfrocaEat acts as an intermediary between merchants (restaurants), delivery drivers, and customers. We facilitate the ordering process and payment collection. However, the merchant is solely responsible for the preparation, quality, and safety of the food provided. AfrocaEat handles refunds according to our refund policy, but disputes regarding food quality must be resolved with the merchant.
4. API Integration and Social Media Posting
Our platform offers partner merchants the ability to link their TikTok account (via the TikTok Developer API) to publish videos of their dishes directly from their AfrocaEat dashboard. By using this feature, the merchant expressly agrees to the following clauses: - Content Responsibility: The merchant retains all intellectual property rights to the uploaded videos. The merchant is solely responsible for the published content and guarantees they hold all necessary rights, licenses, and permissions (including for music and images) before any publication. - Third-Party Rule Compliance: The merchant formally agrees to respect the TikTok Terms of Service and their Community Guidelines. - Abuse Prohibition: It is strictly prohibited to use AfrocaEat Inc.'s publishing tool to disseminate spam, fraudulent content, or material unrelated to the restaurant's gastronomic activity.
5. Revocation and Termination
Any user can, at any time, revoke the access granted to AfrocaEat from the security settings of their TikTok application or directly from the AfrocaEat dashboard. AfrocaEat Inc. reserves the right to immediately suspend, restrict, or terminate access to its platform and publishing tools if a user violates these conditions, engages in fraudulent activity, or violates the policies of our partner social networks.
6. Merchant and Driver Obligations
Partners commit to providing accurate information, strictly respecting local health and hygiene standards, holding necessary licenses, and maintaining professional behavior with customers at all times.
7. Disputes and Jurisdiction
Any dispute related to these terms will be governed by the applicable laws in your primary jurisdiction (Canada, France, or the United States depending on the domain used by the merchant).
